Is North Carolina an At-Fault or No-Fault State?
Who pays after a crash depends on the fault system your state uses.

The driver who caused the crash — and their insurer — pays. North Carolina has no no-fault or PIP system.

This is the harshest fault rule in the country and North Carolina is one of only a few states that still uses it. If you contributed to the crash at all — even 1% — you collect nothing from the other driver. There is no 51% bar and no reduction of damages in proportion to fault: it is all or nothing. Contributory negligence is an affirmative defense, so the other side must plead and prove it (G.S. 1-139).
