Penalties for Driving Without Insurance in Florida
What actually happens when you are caught driving without liability coverage in Florida.
- First offense — fine
- $30
Driving without the required security is a nonmoving traffic infraction (§ 316.646(3)), and § 318.18(2) sets the penalty for a nonmoving violation at $30 before court costs. The real cost in Florida is the suspension and the reinstatement fee, not the fine.
- License / registration suspension
- Driver license and registration suspended
The department suspends both the registration and the driver license of any owner or registrant whose required PIP and property damage coverage was not in full force (§ 324.0221(2)).
- Vehicle impoundment
- License plate seized
An officer must immediately seize the license plate if the driver is also the owner and has been under a chapter 324 suspension for at least 30 days (§ 324.201(3)).
- Annual surcharge
- None
Florida charges no annual surcharge for driving uninsured. It charges an escalating reinstatement fee instead — $150, then $250, then $500 (§ 324.0221(3)).
- SR-22 required afterwards
- Yes
Reinstatement requires securing the coverage described in §§ 324.021(8), 324.023 and 627.7275(2) and keeping proof of it on file for 2 years (§ 324.0221(3)).
