Penalties for Driving Without Insurance in California
What actually happens when you are caught driving without liability coverage in California.
- First offense — fine
- $100 – $200
Plus penalty assessments, which in practice multiply the base fine several times over.
- Subsequent offense — fine
- $200 – $500
Applies to a conviction within three years of a prior one, plus penalty assessments.
- License / registration suspension
- One year after an uninsured crash
A citation alone is an infraction with no suspension. But if you were uninsured in a reportable crash, the driving privilege is suspended for a year and proof of financial responsibility must then be kept for three. Registration is separately suspended when DMV is told coverage ended.
- Vehicle impoundment
- At the court's discretion
The court may order the vehicle impounded for good cause, on top of the fine. It is released to the registered owner only on proof of insurance and payment of towing and storage.
- Annual surcharge
- None
California has no annual driver responsibility surcharge. A one-time $250 penalty fee applies only if you ask DMV for a restricted licence during a financial responsibility suspension.
